These Terms of Service (“Terms”) govern your use of the TheFleek website and the digital services we provide, including eBook creation, web design, Meta Ads campaigns, and custom packages. By purchasing or using our services, you agree to these Terms.
1. Services
TheFleek offers professional digital services as described on our website and in written proposals or invoices. Scope, deliverables, timeline, and pricing are defined per package or custom agreement. We reserve the right to refuse projects that conflict with our policies or capacity.
2. Packages & Custom Work
- Starter, Growth, Scale — fixed-scope packages with the features listed on our site at the time of purchase.
- Custom — scope, pricing, and timeline are agreed in writing before work begins.
Any work outside the agreed scope may incur additional fees after mutual agreement.
3. Payment
Payment terms are stated at checkout or in the project proposal. Unless otherwise agreed:
- Fixed packages are typically paid in full before work starts, or 50% deposit with the balance before final delivery.
- Custom projects may use milestone or deposit schedules as specified in the proposal.
Late payments may pause work until the account is current.
4. Client Responsibilities
You agree to provide timely feedback, required assets (logos, copy, access credentials where needed), and accurate information. Delays in client responses may extend delivery timelines.
5. Intellectual Property
Upon full payment, you receive ownership of the final deliverables created specifically for you (e.g., custom eBook content, website design as delivered). We retain the right to use anonymized work in our portfolio unless you request otherwise in writing. Pre-existing tools, frameworks, or third-party assets remain the property of their respective owners.
6. Revisions
Revision rounds are limited as stated in each package. Additional revisions or major scope changes may be billed separately. “Unlimited revisions” (where offered) apply within the original project scope and a reasonable timeframe.
7. Meta Ads & Third-Party Platforms
For advertising services, you are responsible for providing valid ad account access and remaining compliant with Meta (Facebook/Instagram) policies. Results (ROAS, leads, sales) depend on many factors outside our sole control; we do not guarantee specific performance numbers.
8. Limitation of Liability
To the maximum extent permitted by law, TheFleek’s liability for any claim arising from our services is limited to the amount you paid for the specific project in question. We are not liable for indirect, incidental, or consequential damages.
9. Termination
Either party may terminate a project by written notice. In case of termination by the client after work has begun, fees for work completed and non-refundable deposits are due according to our Refund Policy.
10. Changes
We may update these Terms periodically. Continued use of our services after changes constitutes acceptance. Material changes will be reflected by the “Last updated” date.
